ORDER
FACTS:
1. The appellant sought the certified copies of the opening form and all records of account no. 7218671991 in the name of her deceased husband Mr. Sayyed Anees. The CPIO replied on 30.06.2016 that the manual records sought by appellant were not available at their office and also stated that the appellant did not furnish the identity proof establishing that she is wife of the account holder. The FAA upheld the response of CPIO on 09.09.2016.
Decision :
2. Mr. B.K. Singh, CPIO submitted that the records sought were available in digitised form along with data about the balance amount in account. He stated that the appellant could claim the amount by furnishing the succession or nomination certificate.
3. The appellant demanded the certified copies of the records of account no. 7218671991 but she did not mention the form in which the documents should be supplied. The CPIO erred in replying that the records were not available as he submitted during hearing that manual records had been digitised and the documents sought are available at their office. It is clear that the appellant did not send any identity proof even after the reply of CPIO dated 30.06.2016. The disclosure of information was delayed due to the shortcomings of both the parties. Therefore, the appellant is advised to supply photocopy of certificate proving that Ms. Ruksana Begum is wife of Mr. Sayyed Anees.
4. The Commission directs the Mr. B.K. Singh, CPIO to provide the certified copy of the opening form of account and account statement reflecting the balance amount, within 15 days from this date. SD/-
