Disclosure of information of the bomb blast under RTI

From the Ministry of Home Affairs, state-wise information related to number of bomb blasts that happened from 2002 to June 2011 in which terrorists were suspected to be involved was sought in a particular format under the Right to Information (RTI) Act. The Public Information Officer (PIO) informed the appellant that records/details of bomb blasts/terrorist attacks were kept by the concerned State/UT Governments and accordingly can be obtained from them directly. However, the First Appellate Authority (FAA) directed the PIO to provide the information (as available) which may have been collated by the Ministry while responding to Parliament Questions.

The appellant submitted that the PIO has failed to provide information despite the directions of the FAA. The respondent submitted that the direction of the FAA could not be acted upon, because the information was not available in the manner in which it was sought by the appellant. The Central Information Commission (CIC) remitted the matter back to the FAA with the direction to provide requisite information to the appellant to the extent available with the public authority.
