Copy of the declaration of “No Dowry Given”
25 Feb, 2012
Background
The appellant sought for the certified copies about the declaration given by Shri N.V. Planiappan of RBI “that no element of dowry is involved” in his daughter’s Marriage. The Public Information Officer (PIO) refused for the disclosure of the information stating that the information is held in fiduciary capacity as it is related with the third party and hence exempted under Section 8(1) (e) of the Right to Information [RTI] Act.
View of CIC
The PIO pointed out that the third party had objected for disclosure of the information and the form for the Provident Fund withdrawal for marriage contains other information and its disclosure may cause an invasion of his privacy. The Commission directed the PIO to black out such personal information as per the provisions of Section 10 of the RTI Act. However, if there is any declaration that no dowry was involved, it cannot be blanked out.
