O R D E R
1. The Appellant filed an RTI application dated 05.09.2023 seeking information on the following points:-
I, Abhishek Sharma, (Sr. No.-73921) is an Ex-Senior Manager of the Bank and have joined the Bank on 28.03.2011 at Kolkata and resigned from the Bank on 30.09.2021 (From Treasury Branch, Mumbai), am seeking the following information: -
(i) Year wise break-up of my leave to which I was entitled to avail category wise viz. CL, PL, Medical Leave, Special Leave, Unavailed CL, other type of leave (if any) w.e.f. 28.03.2011 to 30.09.2021. Certified Copies.
(ii) Year wise break-up of leave availed/sanctioned by the Bank under each category viz. CL, PL, Medical Leave, Special Leave, Unavailed CL, other type of leave (if any), loss of pay (if any). Certified Copies.
(iii) Year wise break-up of leave balance at the end of each year under each category viz. CL, PL, Medical Leave, Special Leave, Unavailed CL, other type of leave (if any), loss of pay (if any). Certified Copies.
2. The CPIO replied vide letter dated 13.09.2023 and the same is reproduced as under :-
“Please find Annexure-1 in 1 page.”
3. Dissatisfied with the response received from the CPIO, the Appellant filed a First Appeal dated 27.09.2023 alleging that the information provided was incomplete, false and misleading. The FAA vide order dated 21.10.2023 upheld the reply given by the CPIO.
4. Aggrieved with the FAA’s order, the Appellant approached the Commission with the instant Second Appeal dated 30.11.2023.
5. The appellant’s representative Mr. Akhilesh Chandra and on behalf of the respondent Mr. Sreeja Rani, Chief Manager and Mr. Bobby, Chief Manager attended the hearing through video conference.
6. The appellant inter alia submitted that incomplete information has been provided by the CPIO on point no. 1 and 3 of the RTI application. He requested the Commission to direct the respondent to furnish the information, as sought.
7. The respondent while defending their case inter alia submitted that available information has been provided to the appellant while responding to the appellant on 13.09.2023. She further submitted that information related to the year 2012 to 2014 is not available and as per their record retention policy, they maintain the leave records of their retired employee for 5 years only.

The Commission after adverting to the facts and circumstances of the case, hearing both parties and perusal of records, observes that the CPIO has provided available information to the appellant vide letter dated 13.09.2023. The respondent clarified that information pertaining to the year 2012 to 2014 is not available and is as per their record retention policy. In view of the above, the Commission finds no scope of intervention in the matter.
Accordingly, the appeal is dismissed.
Copy of the decision be provided free of cost to the parties.
