Ref: Information was denied by referring a judgment given by Madras High Court – CIC issued show cause notice stating information has been denied without looking into the fact that the referred judgment had been reviewed by the Court

Comment: It is good that the CIC is taking serious view of the non-providing of information based on some order of the HC without considering whether such order was appealed / reviewed etc. CIC and SICs are issuing a large number of show cause notices to the PIOs why penalty should not be levied. But no information is available in the website of the CIC and SICs of the actual penalties levied, on whom levied and when the same are paid. Since levy of penalty is mandatory if there has been intentional and inordinate delay in
providing information, the particulars of penalties collected from the PIOs with name of organisation must be made available on website of CIC and SICs.
