1. The Appellant filed an RTI application dated 11.08.2023 seeking the following information: -

Kindly refer to Notification No. FSIB No. S2129/08-02-004/2023-2024 dated 15/07/2023, (a copy being enclosed) vide which Shri Pankaj Dwivedi has been placed at Sr. No.14 in the panel and has been recommended for the post of Executive Director in Public Sector Banks. Shri Pankaj Dwivedi is guilty of committing heinous crimes against women, information about which is already available in the public domain.

(i) Certified copies of the Standard Operating Procedure (SOP) adopted by the Bureau for recommending Executive Directors in Public Sector Banks, e.g. identification of posts, Shortlisting of tentative candidates, Mandatory Checklist of relied on records, screening of records, recommendation of candidates, their final appointments etc.

(ii) Name, Designation, official telephone No & Email address of the members of the Committee who have scrutinised the records and recommended Shri Pankaj Dwivedi for the post of Executive Director, in terms of SOP at para 1 above.

(iii) Certified copies of the Vigilance Clearance certificate issued by the Competent Authority and relied by the Bureau before recommending Shri Pankaj Dwivedi for the post of Executive Director.

(iv) Copies of Action Taken Report (ATR) on Complaints of Sexual Harassment against Sh. Pankaj Dwivedi, during his service tenure at Punjab & Sind Bank, as on date of providing information.

(v) Court wise details of litigation which Shri Pankaj Dwivedi is contesting as a Petitioner and/or Defendant, as per records of

Point (v) – a. 3. Dissatisfied with the response received from the CPIO, the Appellant filed a First Appeal dated 31.08.2023 alleging that the information provided was incomplete, false and misleading. The FAA’s order dated 22.09.2023 directed the respondent to provide a revised reply to the Appellant as provision of RTI Act, 2005.

4. Aggrieved with the FAA’s order, the Appellant approached the Commission with the instant Second Appeal dated nil.

5. The appellant remained present in Person and on behalf of the respondent Ms. Pradeep Kaur CPIO, Ms. Neetika Legal Officer attended the hearing through video conference.

6. The appellant inter alia submitted that the main grievance revolves around the refusal of the Financial Services Institutions Bureau (FSIB) to provide critical information related to the appointment of Mr. Pankaj Dwivedi as Executive Director in Public Sector Banks (PSBs). The appellant alleges that the said person who has been accused of heinous crimes against women, was recommended for this high-level position despite his criminal background. The appellant requested detailed information about the selection process, including the standard operating procedures, the members of the committee who recommended Mr. Pankaj Dwivedi, and any vigilance clearance certificates. However, the FSIB denied this information, invoking Section 8(1)(j) Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information: Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person. Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information: Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person. of the RTI Act, which the appellant contends is unjustified and done with the intent to conceal corruption and malpractices within the bureau. The appellant argues that the refusal to disclose such vital public information not only violates the principles of transparency and accountability but also undermines the public's trust in the integrity of the appointment process.

7. The respondent while defending their case inter alia reiterated the denial of information sought in the RTI application by invoking Section 8(1)(j) Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information: Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person. Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information: Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person. Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information: Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person. Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information: Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person. of the RTI Act. The Respondent averred that the disclosure of information that pertains to personal matters, where the disclosure would cause an unwarranted invasion of privacy unless there is a larger public interest involved, is barred to be shared under the RTI Act. Specifically, it was argued that the details regarding the members of the committee who recommended Mr. Pankaj Dwivedi for the post of Executive Director, the vigilance clearance certificate, and information related to his legal cases were personal in nature and thus exempt from disclosure under this provision. The FSIB maintained that revealing such information would not serve any public interest and could potentially violate the privacy rights of the individuals involved. Additionally, the respondent provided web links to general contact information of the ex-officio members available on public websites, further justifying that specific personal contact details of the part-time members were not necessary to be disclosed as they are exclusively called for the interview purpose. The FSIB in its response strictly persisted on privacy concern under the RTI Act, prioritizing the protection of personal data over transparency in the selection process.

8. The Commission after adverting to the facts and circumstances of the case, hearing both parties and perusal of records, observes that the denial of information by the Financial Services Institutions Bureau (FSIB) under Section 8(1)(j) Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information: Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person. Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information: Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person. Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information: Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person. The information sought pertains to personal details and the professional conduct of an individual, the disclosure of which could lead to an unwarranted invasion of privacy without serving any substantial public interest. The Commission notes that the Appellant has sought for the personal information of a third party, which stands exempted from disclosure under Section 8(1) (j) of the RTI Act. In this regard, the attention of the parties is drawn towards a judgment of the Hon’ble Supreme Court in the matter of Central Public Information Officer, Supreme Court of India Vs. Subhash Chandra Agarwal in Civil Appeal No. 10044 of 2010 with Civil Appeal No. 10045 of 2010 and Civil Appeal No. 2683 of 2010 wherein the import of “personal information” envisaged under Section 8(1)(j) Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information: Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person. Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information: Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person. of RTI Act has been exemplified in the context of earlier ratios laid down by the same Court in the matter(s) of Canara Bank Vs. C.S. Shyam in Civil Appeal No.22 of 2009; Girish Ramchandra Deshpande vs. Central Information Commissioner & Ors., (2013) 1 SCC 212 and R.K. Jain vs. Union of India & amp; Anr., (2013) 14 SCC 794. The following was thus held:

“59. Reading of the aforesaid judicial precedents, in our opinion, would indicate that personal records, including name, address, physical, mental and psychological status, marks obtained, grades and answer sheets, are all treated as personal information. Similarly, professional records, including qualification, performance, evaluation reports, ACRs, disciplinary proceedings, etc. are all personal information. Medical records, treatment, choice of medicine, list of hospitals and doctors visited, findings recorded, including that of the family members, information relating to assets, liabilities, income tax returns, details of investments, lending and borrowing, etc. are personal information. Such personal information is entitled to protection from unwarranted invasion of privacy and conditional access is available when stipulation of larger public interest is satisfied. This list is indicative and not exhaustive…”

9. The Commission concurs with this view, emphasizing that the protection of individual privacy is paramount unless an overriding public interest is demonstrated. In this case, the appellant has not provided sufficient grounds to justify that public interest outweighs the right to privacy. Therefore, the denial of the requested information is upheld, and the appeal is accordingly dismissed.
