An application was filed with the Home Department, Kerala under the Right to Information (RTI) Act seeking to know the reasons for the delay by the department in forwarding the recommendation for a CBI inquiry against point man T.G. Nandakumar to the centre.
As the reply to the application, provided by the State Public Information Officer and Under Secretary to the Home Department, was incomplete and vague, the applicant approached the State Information Commission of Kerala for remedy.
After hearing the explanations of the SPIO and examining the files, the information commission agreed with the view of the appellant that the furnished information was incomplete and misleading. The commission, in its order, imposed a fine of Rs. 10,000 on the state public information officer which is to be paid by the officer within 30 days failing which revenue recovery proceedings will be initiated against him.
