1. Provide daily progress made on complaint dated 16/07/2020 filed by the appellant against ex-Army personnel Mr. Vijay Bahadur Yadav, Army No.15172318P.
2. Reasons for delay in taking action on the said complaint.
3. Provide details of the officials who have dealt with the said complaint and how long the same had been pending with him.
4. And other related information.
Grounds for filing Second Appeal
The CPIO did not provide the desired information u/s 8(1)(j) Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information: Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person. Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information: Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person. Submissions made by Appellant and Respondent during Hearing:
The appellant submitted in his second appeal that he is not satisfied with the reply of the CPIO as the information was incorrectly denied u/s 8(1)(j) Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information: Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person. However, he was not present at the VC venue despite due service of notice on 10.11.2022 vide speed post acknowledgment no. ED235386877IN.
The CPIO submitted that an appropriate reply was given to the appellant on 27.03.2021. He also referred to his written submissions dated 28.10.2022.
Observations:
From a perusal of the relevant case records, it is noted that a proper point-wise reply was given to the appellant on 27.03.2021. The contention of the appellant is that the denial of information u/s 8(1)(j) Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information: Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person. Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information: Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person. Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information: Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person. of the RTI Act is not correct as the third party against whom he had sought information had submitted fake documents, altering his date of birth to get recruited into the Army and therefore the matter is of public interest and the information should be provided to him. However, the Commission is not in agreement with the submissions of the appellant as even though he has filed a complaint against the third party, however, all the notings/ correspondence which took place while processing of the said complaint becomes personal information of that third party and except for the final outcome of the complaint, no other information can be provided to the appellant. Therefore, the CPIO was right in denying the information u/s 8(1)(j) Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information: Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person. Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information: Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person. It is also noted that the CPIO in his written submissions dated 28.10.2022 has informed that there is no documentary evidence regarding manipulation of date of birth in civil education certificate in respect of Ex Gnr Vijay Bhadur Yadav and Shri Suryabhan Yadav and he has been already struck off from the strength of the Army on 31st May, 2020. The contents of the complaints do not have any relevance with the facts available in the service documents of the Ex Serviceman. However, the appellant had already filed an FIR which will take separate cognizance of the accusation if the accused is found guilty.
Now that the final outcome has also been provided to the appellant, no further relief can be given.
Decision:
In view of the above, no action lies.
