Commission asked the Rep. of CPIO, JS (Admn.) as to why information was denied under Section 8(1)(j) Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information: Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person. Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information: Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person. Rep. of CPIO submitted that since the letter under reference was filed as a Complaint against a third party functionary of the public authority and in this regard they are guided by the Complaints policy of the Commission vide which action taken on such complaints is treated as personal information.
Decision
Commission observes that the reliance on Section 8(1)(j) Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information: Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person. Central Information Commissioner & Ors. dated 03.10.2012. However, CPIO is directed to intimate categorical statement regarding the outcome of action taken, if any, and in the event no action was taken on the complaint, same will be mentioned in the CPIO reply. Commission’s directions will be complied within 15 days from the date of receipt of this order. The appeal is disposed of accordingly.
