Action taken report on the complaint against the FPS dealer who had stopped giving ration to the appellant despite her ration card being duly stamped - CIC: show cause notice issued to PIO, compensation of Rs 2,700/- awarded to the appellant

FACTS:
1.. The appellant through his RTI application 19.1.2014 is seeking action taken report on his complaint dt 13.1.2013, with which officer it is pending, name and designation of the officer etc. CPIO on 1.2.2014 has provided the pointwise information. Unsatisfied with the information provided, the appellant made first appeal on 14.2.2014. On not receiving any order from the FAA within prescribed time, the appellant made second appeal before the Commission.
DECISION
2. Both parties made their submissions. The appellant submitted that her Ration CardNo.APL54510409 is stamped ration card and she was entitled to get rations from the concerned ration shop. But the FPS dealer stopped giving rations since March, 2014 inspite of the respondet officer Mr. TR Singh, FSO ordering on the ration card to issue the rations.The concerned FPS, M/s Vinayak Stores, Proprietor Mr. Dharmender flatly denied to issue rations. As a result of this, she was taking rations from open market by paying Rs.300/extra(approx.) per month and thus she suffered loss. On the other hand, the respondent officer, Mr. TR Singh submitted that even though he acknowledged on the ration card to issue rations the same has not been updated in the system. Therefore, they are at fault and the fault also lies on the FPS dealer, who did not seek clarification from the office.

The Commisison having heard and having perused the record in the file, directs the respondent/PIO to show cause why maximum penalty cannot be imposed on him for not giving information to the appellant about the reasons for stopping her rations, within the prescribed period. His explanation should reach the Commisison within 3 weeks from the date of receipt of this order. He is also directed to pay a compensation of Rs.2,700/to the appellant for the loss suffered by her.
