RTI application
1. The appellant filed an RTI application with the PIO on 8.3.2013 seeking address(es), as available in the passport records of a couple mentioned in the RTI application. Besides, he also sought addresses of the witnesses mentioned in the said couple’s passport application forms.
2. On not receiving any reply from the PIO, the appellant filed an appeal on 10.4.2013 with the first appellate authority (FAA). The PIO expressed his inability on 14.4.2013 to trace the passport details in the absence of any file number(s). The PIO further informed the appellant that even if the records were traced out, the information could not be provided to him under section 8(1)(j) Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information: Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person. Hearing
3. The appellant and the respondent both participated in the hearing personally.
4. The appellant referred to his RTI application of 8.3.2013 through which he had sought the addresses of certain persons from the respondent organization. The appellant stated that the addresses which he was seeking, belonged to persons who had defrauded him and he wanted to proceed against them. The appellant stated that the CPIO had replied on 14.4.2013 that the information cannot be provided under section 8(1)(j) Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information: Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person. The respondent stated that the information that the appellant was seeking, was denied to him as it was clearly a third party information and hence section 8(1)(j) Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information: Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person. Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information: Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person. 6. The appellant stated that the respondent should have proceeded under section 11(1) Where a Central Public Information Officer or a State Public Information Officer, as the case may be, intends to disclose any information or record, or part thereof on a request made under this Act, which relates to or has been supplied by a third party and has been treated as confidential by that third party, the Central Public Information Officer or State Public Information Officer, as the case may be, shall, within five days from the receipt of the request, give a written notice to such third party of the request and of the fact that the Central Public Information Officer or State Public Information Officer, as the case may be, intends to disclose the information or record, or part thereof, and invite the third party to make a submission in writing or orally, regarding whether the information should be disclosed, and such submission of the third party shall be kept in view while taking a decision about disclosure of information: of the RTI Act for getting the consent of the concerned person whose addresses he was seeking.
7. The respondent stated that they would not be able to trace out the persons because the system operates on the basis of three critical data inputs, i.e., name, father’s name and date of birth of the passport holder.
8. The respondent stated that their submissions are
(i) that this is a third party information and, therefore, cannot be provided and
(ii) they cannot, in any case, identify the person in the absence of the three critical data inputs mentioned above.
9. The respondent further stated that even if the three critical data inputs are made available and they are able to identify the person, they can provide information only about the passport number, date of issue and date of expiry. The respondent stated that this was in accordance with a Delhi High Court order.
Decision
10. The action taken by the respondent is upheld. No intervention of the Commission is required in the matter. The appeal is disposed of. Copy of the decision be given free of cost to both the parties.
