Information sought:
The Appellant filed an RTI application dated 18.04.2022 seeking the following information:
“(1) Certified copy of the latest advertisement for the post of Administrative Officer, National Zoological Park New Delhi published in the Employment News or any other newspaper.
(2) Certified copies of the applications received in response to the said advertisement.
(3) Certified copy of the list of names shortlisted for holding Departmental Promotion Committee meeting for selection of the candidate for the said post.
(4) Posts and names of the Chairman and Members of the Departmental Promotion Committee for the post of Administrative Officer, National Zoological Park, New Delhi.
(5) certified copy of the entire noting portion of file bearing No. III-125/2021-NZP in which the matter of filling up the post of Administrative Officer in NZP is being dealt.”
The CPIO replied to the appellant on 17-24.05.2022 stating that the ‘information sought by you is personal information comes under section 8(1)(j)

Being dissatisfied, the appellant filed a First Appeal dated 11.06.2022. FAA’s order dated 12-19.07.2022, upheld the reply of the CPIO. Feeling aggrieved and dissatisfied, the appellant approached the Commission with the instant Second Appeal.
Relevant Facts emerging during Hearing:
The following were present:-
Appellant: Represented by Deepika Tiwari through intra-video conference.
Respondent: Anamika, JD & CPIO along with Shagufta present through intra-video conference.
The Rep. of the Appellant stated that since the Appellant had an exigency, the case may be rescheduled for hearing.
The Commission rejected the request of the Rep. of the Appellant as no prior intimation for the adjournment was received and no tenable cause was stated for the same.
The CPIO submitted that the Appellant has been provided with a revised reply provided to the RTI Application on 28.09.2022.
Decision:
The Commission based on a perusal of the facts on record observes that the original reply of the CPIO indicating square denial of the information sought for in the instant RTI Application under Section 8(1)(j)

of the RTI Act was appropriate except for point no.1 of the RTI Application. In other words, the information sought for at points 2,3,4,5 entailed disclosure of the personal information of third parties, and the same stands exempted under Section 8(1)(j)

In this regard, the attention of the Appellant is further drawn towards a judgment of the Hon’ble Supreme Court in the matter of Central Public Information Officer, Supreme Court of India Vs. Subhash Chandra Agarwal in Civil Appeal No. 10044 of 2010 with Civil Appeal No. 10045 of 2010 and Civil Appeal No. 2683 of 2010 wherein the import of “personal information” envisaged under Section 8(1)(j)

of RTI Act has been exemplified in the context of earlier ratios laid down by the same Court in the matter(s) of Canara Bank Vs. C.S. Shyam in Civil Appeal No.22 of 2009; Girish Ramchandra Deshpande vs. Central Information Commissioner & Ors., (2013) 1 SCC 212 and R.K. Jain vs. Union of India & Anr., (2013) 14 SCC 794. The following was thus held:
“59. Reading of the aforesaid judicial precedents, in our opinion, would indicate that personal records, including name, address, physical, mental and psychological status, marks obtained, grades and answer sheets, are all treated as personal information. Similarly, professional records, including qualification, performance, evaluation reports, ACRs, disciplinary proceedings, etc. are all personal information. Medical records, treatment, choice of medicine, list of hospitals and doctors visited, findings recorded, including that of the family members, information relating to assets, liabilities, income tax returns, details of investments, lending and borrowing, etc. are personal information. Such personal information is entitled to protection from unwarranted invasion of privacy and conditional access is available when stipulation of larger public interest is satisfied. This list is indicative and not exhaustive…”
However, the revised point-wise reply of 28.09.2022 adequately suffices the lacunae observed in the original reply of 24.05.2022 with respect to point no.1 of the RTI Application leaving no scope of intervention at this stage.
The CPIO is nonetheless warned to exercise due diligence while replying to the RTI Application(s) in future.
The appeal is disposed of accordingly.
