Allahabad HC directs personal presence of Ballia CMO in RTI matter

A division bench of Justices Vineet Saran and Mushaffey Ahmed of the Allahabad High Court directed the Chief Medical Officer (CMO) of Ballia district to be physically present in the Court on November 7 when the case would be heard next. The bench passed the order while hearing a petition in a RTI matter where it was prayed that the information sought by the petitioner should be made available to him within the statutory period. Directions were also from the high court to expeditiously dispose of the second appeal pending before the State Information Commission.
On November 24, 2011 an application was filed with the CMO under the Right to Information (RTI) Act seeking information about the charges which the citizens were supposed to pay for getting birth and death certificates issued. When no information was provided within the stipulated time, the applicant filed the first appeal with the District Magistrate who is the First Appellate Authority. On not getting any response, the applicant approached the State Information Commission by filing the second appeal which is still pending.
