2. Appellant by his RTI application sought copy of MLC and Doctor’s opinion on Jaspal Singh, Surjeet Singh , Baby Nanki and Neeraj Sharma. PIO denied the information under section 8(1) (e) of the RTI Act. Being unsatisfied with the PIO reply, appellant filed first appeal. First appellate authority upheld PIO reply. Being unsatisfied with the FAA order, appellant approached the Commission in second appeal.
DECISION:
3. The appellant made his submissions. The appellant submitted that in a clash with his neighbor on 8-10-2014, he was seriously injured on his head and the injuries were shown, in the MLC as simple and those of his opponents were shown as grievous, even though they are simple injuries. As a result, the police filed criminal case against him under section 308 IPC, attempt to murder. Hence he is seeking the MLC of Jaspal Singh (himself), Surinder Singh and Neeraj Sharma in order to fight his case in the court.
4. Having heard the submissions, the Commission finds merit in the contentions of the appellant and hence directs the respondent authority to provide MLC of Jaspal Singh, Surinder Singh and Neeraj Sharma to the appellant within 15 days from the date of receipt of this order.
5. The appeal is disposed of accordingly.
