Appellant argued that an incorrect statement was given that information "has already been published (in bilingual) on the website under relevant headings" - whereas the website OF Cabinet Secretariat has no headings corresponding to 4(1)(b) Every public authority shall publish within one hundred and twenty days from the enactment of this Act,- (i) the particulars of its organisation, functions and duties; (ii) the powers and duties of its officers and employees; (iii) the procedure followed in the decision making process, including channels of supervision and accountability; (iv) the norms set by it for the discharge of its functions; (v) the rules, regulations, instructions, manuals and records, held by it or under its control or used by its employees for discharging its functions; (vi) a statement of the categories of documents that are held by it or under its control; (vii) the particulars of any arrangement that exists for consultation with, or representation by, the members of the public in relation to the formulation of its policy or implementation thereof; (viii) a statement of the boards, councils, committees and other bodies consisting of two or more persons constituted as its part or for the purpose of its advice, and as to whether meetings of those boards, councils, committees and other bodies are open to the public, or the minutes of such meetings are accessible for public; (ix) a directory of its officers and employees; (x) the monthly remuneration received by each of its officers and employees, including the system of compensation as provided in its regulations; (xi) the budget allocated to each of its agency, indicating the particulars of all plans, proposed expenditures and reports on disbursements made; (xii) the manner of execution of subsidy programmes, including the amounts allocated and the details of beneficiaries of such programmes; (xiii) particulars of recipients of concessions, permits or authorisations granted by it; (xiv) details in respect of the information, available to or held by it, reduced in an electronic form; (xv) the particulars of facilities available to citizens for obtaining information, including the working hours of a library or reading room, if maintained for public use; (xvi) the names, designations and other particulars of the Public Information Officers; (xvii) such other information as may be prescribed and thereafter update these publications every year; Every public authority shall publish within one hundred and twenty days from the enactment of this Act,- (i) the particulars of its organisation, functions and duties; (xii) the manner of execution of subsidy programmes, including the amounts allocated and the details of beneficiaries of such programmes; (xiii) particulars of recipients of concessions, permits or authorisations granted by it; (xiv) details in respect of the information, available to or held by it, reduced in an electronic form; (xv) the particulars of facilities available to citizens for obtaining information, including the working hours of a library or reading room, if maintained for public use; (xvi) the names, designations and other particulars of the Public Information Officers; (xvii) such other information as may be prescribed and thereafter update these publications every year; (iii), (iv), (v) and (vi) and only a perfunctory 'Organization Chart' way short of DOPT guidelines is published in compliance with Section 4 (1) (b) (iii). Furthermore, no information in compliance of Section 4 (1) (b) (iv) is published till date and for Section 4 (1) (b) (v) only the business rules are published. She also stated that her first appeals were disposed off mechanically in a cyclostyled manner without application of mind. Commission is of the view that an appropriate response as per the provisions of the RTI Act has been provided by the Respondent
Information sought and background of the case:
The Appellant filed an RTI application dated 11.02.2022 seeking information on the following points:-
“Request for information about Cabinet Secretariat functions in respect of Rules of Business.
Item no.2 of the two items listed under Cabinet Secretariat in Second Schedule to the Government of India (Allocation of Business) Rules, 1961 is Rules of Business. Information about the functioning of Cabinet Secretariat in respect of it is not duly disclosed in manner that is meaningful or even consistent. To begin with, the item is VARIOUSLY DESCRIBED on the website: in the description of Functions published at https://cabsec.gov.in/aboutus/functions/second paragraph says that Cabinet Secretariat is responsible for the ADMINISTRATION OF Rules of Business, in RTI disclosure at https://cabsec.gov.in/righttoinformation/poweranddutiesofofficials/, the second of two items is TO FRAME Rules of Business, and in FAQ published at https://cabsec.gov.in/righttoinformation/faqunderrighttoinformationact200 5/, reply to FAQ no.4 is that Cabinet Secretariat DEALS WITH PROPOSALS FOR AMENDMENT IN Rules of Business. For none of these various descriptions is procedure etc disclosed or decipherable, e.g., in the Work Distribution in Cabinet Secretariat that is published at https://cabsec.gov.in/righttoinformation/workdistribution/ work relating to Council of Ministers, Govt. of India (Transaction of Business) Rules, 1961, Govt. of India (Allocation of Business) Rules, 1961, Cabinet and Cabinet Committees is listed cursorily against Shri. Ashutosh Jindal, Joint Secretary, who is among officers listed against Shri. Pankaj Agrawal, Additional Secretary, and in the Organisation Chart that is published at https://cabsec.gov.in/righttoinformation/organizationchart/ the blue box containing JS(AJ) is linked with blue line to orange box containing AS(PA) and also by orange line to purple box containing Cabinet Secretary, with no note explaining the dual channel of supervision.
THEREFORE, please provide, separately for the AOB and TOB Rules and most expeditiously, detailed information in terms of clauses (iii), (iv) and (v) and any other applicable clauses of section 4(1)(b) Every public authority shall publish within one hundred and twenty days from the enactment of this Act,- (i) the particulars of its organisation, functions and duties; (ii) the powers and duties of its officers and employees; (iii) the procedure followed in the decision making process, including channels of supervision and accountability; (iv) the norms set by it for the discharge of its functions; (xii) the manner of execution of subsidy programmes, including the amounts allocated and the details of beneficiaries of such programmes; (xiii) particulars of recipients of concessions, permits or authorisations granted by it; (xiv) details in respect of the information, available to or held by it, reduced in an electronic form; (xv) the particulars of facilities available to citizens for obtaining information, including the working hours of a library or reading room, if maintained for public use; (xvi) the names, designations and other particulars of the Public Information Officers; (xvii) such other information as may be prescribed and thereafter update these publications every year; Every public authority shall publish within one hundred and twenty days from the enactment of this Act,- (i) the particulars of its organisation, functions and duties; (vii) the particulars of any arrangement that exists for consultation with, or representation by, the members of the public in relation to the formulation of its policy or implementation thereof; (viii) a statement of the boards, councils, committees and other bodies consisting of two or more persons constituted as its part or for the purpose of its advice, and as to whether meetings of those boards, councils, committees and other bodies are open to the public, or the minutes of such meetings are accessible for public; (ix) a directory of its officers and employees; (x) the monthly remuneration received by each of its officers and employees, including the system of compensation as provided in its regulations; (xi) the budget allocated to each of its agency, indicating the particulars of all plans, proposed expenditures and reports on disbursements made; (xii) the manner of execution of subsidy programmes, including the amounts allocated and the details of beneficiaries of such programmes; (xiii) particulars of recipients of concessions, permits or authorisations granted by it; (xiv) details in respect of the information, available to or held by it, reduced in an electronic form; (xv) the particulars of facilities available to citizens for obtaining information, including the working hours of a library or reading room, if maintained for public use; (xvi) the names, designations and other particulars of the Public Information Officers; (xvii) such other information as may be prescribed and thereafter update these publications every year; of the RTI Act about the functioning of the Cabinet Secretariat in respect of the business item Rules of Business allocated to it (including details of its administration thereof, its framing thereof and its dealing with proposals for amendments therein).”
The CPIO vide letter dated 10.03.2022 replied as under:
As per the provisions under RTI Act, 2005 only such information can be supplied that is available and existing and is held by the public authority or is held under the control of the public authority. The Public Information Officer is not supposed to create information that is not a part of the record of the public authority. The Act, however, does not require the Public Information Officer to deduce some conclusion from the material and supply the conclusion so deduced to the applicant. It means that the Public Information Officer is required to supply the material in the form as held by the public authority, but not to do research on behalf of the citizen to deduce anything from the material and then supply it to him. The updated work allocation and organization chart has been uploaded on the website of the Cabinet Secretariat.”
Dissatisfied with the response received from the CPIO, the Appellant filed a First Appeal dated 11.03.2022. The FAA vide order dated 22.03.2022 upheld the CPIO's reply.
Aggrieved and dissatisfied, the Appellant approached the Commission with the instant Second Appeal.
A written submission has been received from the Appellant vide letter dated 01.01.2024 wherein she inter alia submitted that the website of Cabinet Secretariat states at the outset that it “is responsible for the administration of” Rules of Business. However, the website does not have clause wise disclosure u/s 4 (1) (b). She also stated that 7 other first appeals are disposed off by the FAA using the same standard process sheet. The FAA is also the nodal officer for disclosure u/s 4 based on DoPT guidelines. However, both PIO/ FAA have evaded the issue of poor disclosure u/s 4 (1) (b) of the RTI Act, 2005.
Another written submission dated 03.01.2024 has been received from the Appellant refuting the written submission of the Respondent on various counts including the following:
2. I state the following in rejoinder to CPIO's letter:
2.1. CPIO's subject line description of my case is wrong. I have no matter "Vs. CPIO". My Appeal u/s 19(3) A second appeal against the decision under sub-section (1) shall lie within ninety days from the date on which the decision should have been made or was actually received, with the Central Information Commission or the State Information Commission: Provided that the Central Information Commission or the State Information Commission, as the case may be, may admit the appeal after the expiry of the period of ninety days if it is satisfied that the appellant was prevented by sufficient cause from filing the appeal in time. of RTI Act arises u/r 8 of the RTI Rules. It lies against decision of FAA and is for exercise of the Commission's powers u/s 19(8) that lie against the PA.
2.2 The following phrases/words in CPIO's para-1 to 5 are wrong in law (and, although attributable to DOPT's RTI Online, are independently used by CPIO):
Para-1: "her RTI application (Reg. No. CABST/R/E/22/00096/1 dated 11.02.22)". That Reg. No. is not of request made with fee u/s 6(1) (nor is it dated 11/02/22).
Para-2: "partial transfer from another CPIO... of this Secretariat". RTI Act has no provision for "transfer" within the PA.
Para-2 & Para-4: "reply". The word occurs nowhere in RTI Act. RTI Act mandates disposals by "decision" u/s 7(1) Subject to the proviso to sub-section (2) of section 5 or the proviso to subsection (3) of section 6, the Central Public Information Officer or State Public Information Officer, as the case may be, on receipt of a request under section 6 shall, as expeditiously as possible, and in any case within thirty days of the receipt of the request, either provide the information on payment of such fee as may be prescribed or reject the request for any of the reasons specified in sections 8 and 9: and u/s 19(6).
2.3. CPIO's para 1-5 and Annexures A-D are superfluous. They add no facts not already on record in 2nd Appeal. Para 1, 3 & 5 contain inexact descriptions obfuscating my request, 1st appeal and 2nd Appeal.
2.4. CPIO's para-6 has no para-wise reply to 2nd Appeal and contains false assertions:

Furthermore, no information in compliance of Section 4 (1) (b) (iv) is published till date and for Section 4 (1) (b) (v) only the business rules are published. She also stated that her first appeals were disposed off mechanically in a cyclostyled manner without application of mind.

(xvi) the names, designations and other particulars of the Public Information Officers; (xvii) such other information as may be prescribed and thereafter update these publications every year; Every public authority shall publish within one hundred and twenty days from the enactment of this Act,- (i) the particulars of its organisation, functions and duties; (ii) the powers and duties of its officers and employees; (iii) the procedure followed in the decision making process, including channels of supervision and accountability; (iv) the norms set by it for the discharge of its functions; (v) the rules, regulations, instructions, manuals and records, held by it or under its control or used by its employees for discharging its functions; (vi) a statement of the categories of documents that are held by it or under its control; (ix) a directory of its officers and employees; (x) the monthly remuneration received by each of its officers and employees, including the system of compensation as provided in its regulations; (xi) the budget allocated to each of its agency, indicating the particulars of all plans, proposed expenditures and reports on disbursements made; (xii) the manner of execution of subsidy programmes, including the amounts allocated and the details of beneficiaries of such programmes; (xiii) particulars of recipients of concessions, permits or authorisations granted by it; (xiv) details in respect of the information, available to or held by it, reduced in an electronic form; (xv) the particulars of facilities available to citizens for obtaining information, including the working hours of a library or reading room, if maintained for public use; (xvi) the names, designations and other particulars of the Public Information Officers; (xvii) such other information as may be prescribed and thereafter update these publications every year; of the RTI Act.

every public authority has to publish
(a) the procedure followed in the decision making process, including channels of supervision and accountability;
(b) the norms set by it for the discharge of its functions;
(c) the rules, regulations, instructions, manuals and records, held by it or under its control or used by its employees for discharging its functions
The information under pro-active disclosure in respect of this Secretariat has already been published (in bilingual) on the website of this Secretariat under relevant headings. Accordingly, undersigned vide reply dated 10.03.2022, informed the applicant that the updated work allocation and organization chart has been uploaded on the website of the Cabinet Secretariat.
(b) The applicant had also sought the details of administration, framing and dealing with proposals for amendments in respect of AOB and TOB Rules. In this regard, it is submitted that the undersigned is not concerned with this information and the RTI application had already been forwarded to concerned CPIO of this Secretariat by the nodal officer.”
Decision:
Keeping in view the facts of the case and the submissions made by both the parties, the Commission is of the view that an appropriate response as per the provisions of the RTI Act, 2005 has been provided by the Respondent as only such information that is held and available in the records of a public authority can be provided. Hence, no further intervention of the Commission is required in the instant matter.
With the above observation, the instant Second Appeal stands disposed off accordingly.
