Case closed by the police without informing the court or the complainant
19 Dec, 2012A complaint was registered in 1990 at Juhu police station under IPC sections 379 (theft) and 341 (wrongful restraint). The complainant alleged that every time he asked for a copy of the FIR, police denied it to him telling that the case was under investigation. In 2008, Police had filed an affidavit in court stating that the case was found to be false by a court; hence the accused was acquitted and the case closed.
Then the complainant filed an application under the Right to Information (RTI) Act seeking the details regarding the acquittal and the court proceeding. In response, he received a copy of the FIR which showed that the case was never heard in a court and the Assistant Commissioner of Police (ACP) had closed it in 1990 itself without informing the court or the complainant. The copy of the FIR mentions that the case was registered only under section 341, but details of the crime register showed the case was filed under sections 341 & 379 both.
Now, the complainant has filed a criminal writ petition before the Bombay high court, demanding action against the police for closing the case without his knowledge and for manipulating documents.
