Reasons for grant of prosecution

The Appellant wanted to know about the basis on which permission had been granted for his prosecution. The PIO refused to disclose the information with the observation that the Appellant's request was in the form of queries. The First Appellate Authority, while endorsing the decision of the PIO, observed that the appellant had not enclosed the required fees.

The Commission held that ir-respective of whether the RTI request is in the form of a query or for seeking copies of records, the PIO must find out the relevant records and documents in the possession of the public authority which answer the information seeker’s requests/queries and provide the copies of those. The FAA was also advised by the Commission not to insist for any fee since the Central Government rules do not prescribe any fee for filing appeals.
