(xvi) the names, designations and other particulars of the Public Information Officers; (xvii) such other information as may be prescribed and thereafter update these publications every year; Every public authority shall publish within one hundred and twenty days from the enactment of this Act,- (i) the particulars of its organisation, functions and duties; (ii) the powers and duties of its officers and employees; (iii) the procedure followed in the decision making process, including channels of supervision and accountability; (iv) the norms set by it for the discharge of its functions; (v) the rules, regulations, instructions, manuals and records, held by it or under its control or used by its employees for discharging its functions; (vi) a statement of the categories of documents that are held by it or under its control; (vii) the particulars of any arrangement that exists for consultation with, or representation by, the members of the public in relation to the formulation of its policy or implementation thereof; (viii) a statement of the boards, councils, committees and other bodies consisting of two or more persons constituted as its part or for the purpose of its advice, and as to whether meetings of those boards, councils, committees and other bodies are open to the public, or the minutes of such meetings are accessible for public; Grounds for the Second Appeal: The CPIO has not provided the desired information.
Relevant Facts emerging during Hearing:
The following were present Appellant: Mr. Nitin Sudhakar Pradhan M: Respondent: Mr. Pankaj Porwal CPIO through VC
The appellant stated that copy of sample check audit carried out by the TERM Cell Mumbai in September 2011 has not been given on the grounds that it contains third party information overlooking the provisions of section 10 of the RTI Act which provides for severance of information which is not disclosable. He further pleaded that he specifically requires the months in which the sample audit was conducted after September 2011 till the date of his RTI application and the information requested under item 3.3.13(2). While concluding the appellant pointed out that the CPIO has not followed the provision of Section 10(2) of the RTI Act as no notice was given to him and has also not provided certified copies of documents though specifically requested in the RTI application. The CPIO stated that he will go through the audit report for September 2011 and in case it contains information relating to the appellant the same will be provided after severing information relating to third party(s). As regards information relating to the months in which the sample audit was conducted the CPIO explained that audit is an ongoing process and it is not necessary that it should take place each month and/or concluded during the month itself, however, he will go through the records and provide the month and date(s) on which the audit was undertaken/concluded during the above period. The CPIO further stated that the information requested under query 3.3.13 (2) is not available in material form and the same has been intimated to the appellant. As regards certified copies of the documents the CPIO stated that the photocopies supplied to the appellant bears the date, designation and signature of the official(s) and if the appellant desires the official stamp can be fixed. The CPIO concluded by stating that Section 10(2) has not been violated as it can be seen from the appellant’s RTI application that he has sought information pertaining to himself which has been duly extracted and supplied. The appellant stated that he had specifically asked for stamped copies of certified documents and pointed out that the respondents have replied after 42 days as against the mandatory period of 30 days. The CPIO stated that the RTI application was filed with the Director (PG) DoT Delhi and was received at his office on 27/7/2012 and the reply was given timely on 24/8/2012. The appellant stated that though he has not mentioned anything in his 2nd appeal but he has sent a mail to the Commission pointing out deficiencies against two offices viz. Director (PG) and Director(S-I).
Interim Decision notice: The CPIO is directed to supply the following:
1- The extract of the sample audit report of September 2011 to the extent it relates to the appellant.
2- The period & date of conclusion of sample audit(s) conducted during the period September 2011 to July 2012.
3- Affix the office stamp on the photocopies of the documents supplied/ to be supplied to the appellant.
The above information should be supplied to the appellant, free of cost, within 15 days from the date of receipt of this order.

The CPIO stated that as ordered in the last hearing the information has been supplied. The appellant pointed out that it is obvious that the remaining information has been supplied only after the directions of the Commission and there were previous instances also where the respondent supplied some information after the matter was heard by the Commission. He pleaded for initiating disciplinary action against the CPIO and the FAA. The CPIO contended that it is obvious from the proceedings before the Commission that every effort has been made to provide information to the appellant in response to his various RTI applications and the Commission’s orders have also been meticulously complied in a timely manner and that there is/was no intent whatsoever to delay/deny any information to the appellant.
Decision Notice:
It seen from the record that the appellant in his 2nd appeal to the Commission has enclosed a copy of his RTI application dated 12/07/2012, PIO/Director (Term) reply dated 24/08/2012 and copy of his 1st appeal dated 24/09/2012 addressed to the DDG (Term) Mumbai and all the points raised by him in his 2nd appeal have been covered in his oral submissions made before the Commission on 29/04/2014. Hence, at this stage he cannot be allowed to raise any fresh issue(s) against other officers viz. Director (PG) and Director (SI). As all the information sought in the appellant’s 2nd appeal has already been provided, the only issue to be decided is on his plea to initiate disciplinary proceeding against the PIO/Director (Term)/FAA. The PIO in his submissions has already explained that the appellant had filed his RTI application with the Director (PG) DoT Delhi which was received at his office in Mumbai on 27/07/2012 and the reply was given timely on 24/08/2012. He has further stated that every effort has been made to supply information to the appellant in response to his various RTI applications and the Commission’s orders have been meticulously complied in a timely manner. Section 20(2) Where the Central Information Commission or the State Information Commission, as the case may be, at the time of deciding any complaint or appeal is of the opinion that the Central Public Information Officer or the State Public Information Officer, as the case may be, has, without any reasonable cause and persistently, failed to receive an application for information or has not furnished information within the time specified under sub-section (1) of section 7 or malafidely denied the request for information or knowingly given incorrect, incomplete or misleading information or destroyed information which was the subject of the request or obstructed in any manner in furnishing the information, it shall recommend for disciplinary action against the Central Public Information Officer or the State Public Information Officer, as the case may be, under the service rules applicable to him. of the RTI Act reads as under: 2) Where the Central Information Commission or the State Information Commission, as the case may be, at the time of deciding any complaint or appeal is of the opinion that the Central Public Information Officer or the State Public Information Officer, as the case may be, has, without any reasonable cause and persistently, failed to receive an application for information or has not furnished information within the time specified under sub-section (/) of section 7 or malafidely denied the request for information or knowingly given incorrect, incomplete or misleading information or destroyed information which was the subject of the request or obstructed in any manner in furnishing the information, it shall recommend for disciplinary action against the Central Public Information Officer or the State Public Information Officer, as the case may be, under the service rules applicable to him. The legal position in respect of penal proceedings has been examined and clarified by the Hon’ble Delhi High Court in its decision dated 02/02/2012 (W.P.(C) 766/2010 & CM No. 1611/2010) holding as under:- “The aspect of levy of penalty on the PIO is governed by Section 20 of the Right to Information Act (RTI Act). It states that the CIC may at the time of deciding any complaint or appeal impose penalty on the CPIO, where he is of the opinion that the CPIO has, without any reasonable cause, refused to receive an application for information or has not furnished information within the time specified under sub-section (1) of section 7 or malafidely denied the request for information or knowingly given incorrect, incomplete or misleading information or destroyed information which was the subject of the request or obstructed in any manner in furnishing the information. The crux of the said provision is that the PIO should have obstructed the supply of the information with intent or should have acted consciously and deliberately in a manner so as to block the provision of the information.” In its subsequent decision dated 1/6/2012 the Hon’ble Delhi High Court in the matter of Registrar of Companies & Ors. vs. Dharmendra Kumar Garg & Anr. W.P.(C) 11271/2009, while deliberating on the issue of penal proceedings, has observed as under: “61. …………………. It can happen that the PIO may genuinely and bonafidely entertain the belief and hold the view that the information sought by the querist cannot be provided for one or the other reasons. Merely because the CIC eventually finds that the view taken by the PIO was not correct, it cannot automatically lead to issuance of a show- cause notice under Section 20 of the RTI Act and the imposition of penalty. The legislature has cautiously provided that only in cases of malafides or unreasonable conduct, i.e., where the PIO, without reasonable cause refuses to receive the application, or provide the information, or knowingly gives incorrect, incomplete or misleading information or destroys the information, that the personal penalty on the PIO can be imposed. This was certainly not one such case. If the CIC starts imposing penalty on the CPIO in every other case, without any justification, it would instill a sense of constant apprehension on those functioning as PIOs in the public authorities and would put undue pressure on them. They would not be able to fulfill their statutory duties under the RTI Act with an independent mind and with objectivity. Such consequence would not auger well for the future development and growth of the regime that the RTI Act seeks to bring in, and may lead to skewed and imbalanced decisions by the PIOs Appellate Authorities and the CIC………...” In facts and circumstances of the matter at hand it is evident that the CPIO’s acts did not constitute any persistent refusal to receive application or malafide denial of the request for information or knowingly giving incorrect, incomplete or misleading information or destruction of information or obstruction in any manner in furnishing the information. Thus, in the light of the aforementioned judicial pronouncements, no case for initiating penal proceedings/disciplinary action against the CPIO is made out. In view of the appellant’s repeated pleas, it is pertinent to clarify at this point that there is no provision in the RTI Act to initiate any penal/disciplinary action against the Appellate Authority. Thus, the contentions of the appellant to that effect are misconceived and not maintainable in law. Since, the information as sought by the appellant has already been furnished, nothing more remains to be adjudicated. The matter stands disposed of accordingly.
