O R D E R
Facts:
1. The appellant filed an RTI application on 22-5-2012 requesting for a copy of the departmental enquiry report against his father who was a railway employee and related issues.
2. The CPIO responded on 24-7-2012, providing information to the appellant. The appellant filed an appeal with the first appellate authority (FAA) on 1482012. The FAA did not respond. The appellant approached the Commission on 17-10-2012 in a second appeal.
Hearing:
3. I heard both the parties through videoconferencing.
4. The appellant referred to his RTI application of 22-5-2012 and stated that in his RTI application he had sought a copy of departmental inquiry report against his father who retired in 1993 from the Railways. The appellant stated that at the time of his father’s retirement and subsequent death, he was a small child and could not fight the case. The appellant stated that now he wants pension for his mother and job for himself from the Railways.
5. The respondent stated that the appellant wants a copy of departmental inquiry report which was conducted against his father. The respondent stated that it is 20 years old case and the record is not available. The respondent stated that he does not know about the appellant’s father and his record. The respondent stated that the Railways maintain its record retention schedule only for 10 years and the departmental proceedings report is also not available.
Decision:
6. The respondent is directed to provide a copy of the record retention schedule to the appellant within 30 days of this order. Appeal is disposed of. Copy of this order be given free of cost to the parties.
