FACTS
Vide RTI dt 23.8.2013 appellant had sought following information in respect of Lt. Col. Hari Singh:
i) Copy of non-employment affidavit submitted by him; and
ii) Copy of Form 26AS submitted.
2. PIO, MoD, Directorate General, Resettlement vide letter dt 26.8.2013 denied the information as it is personal in nature under 8(i) and 8(j) of the RTI Act.
3. An appeal was filed on 30.8.2013 4. AA vide order dt 14.10.2013 upheld the decision of the PIO.
5. Submissions made by the appellant and public authority were heard. Public Authority has submitted written submissions which are taken on records and a copy is provided to the appellant also. CPIO submitted that information has been denied u/s 8(1)(j) Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information: Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person. Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information: Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person. Appellant submitted that he was seeking copy of the affidavit as corruption was involved and the affidavit submitted by the officer is false. The Commission has directed the appellant to file his written submissions to the Commission with a copy to the respondents. The public authority has requested one week’s time to respond to the submission filed by the appellant to which the Commission has agreed to. 25.04.2014
6. Written submissions dt 9.4.14 from the appellant and counter submission dt 21.4.14 from the public authority have been received and perused.
7. Appellant has submitted that a large number of false affidavits/Form 26AS are filed with DGR by ex-servicemen, while submitting application for second employment. Hence larger public interest is involved in disclosure of information sought by him.

Public authority has submitted that the appellant is an ex-beneficiary of welfare schemes and was involved in irregularities and malpractices resulting in the withdrawal of empanelment of his security agency. Thereafter, he has resorted to indiscriminate RTI applications and appeals out of vengeance. He has filed 106 applications/appeals during the last one and a half year, which are becoming an impediment in the smooth functioning of DGR. It is also submitted that notice u/s 11 was sent to Shri Hari Singh, third party, calling for his views, who in response has stated that the information sought is personal and confidential.
DECISION

The Hon’ble Supreme Court in the case of Girish Ramchandra Deshpande, has held that Income Tax Returns and related documents are personal information and hence exempt from disclosure u/s 8(1)(j) Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information: Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person. Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information: Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person. Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information: Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person. Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information: Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person. of the RTI Act, unless a larger public interest is involved. We accordingly uphold the decision of the CPIO/AA in denying copy of Form 26AS u/s 8(1)(j) Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information: Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person. Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information: Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person. Insofar as seeking a copy of the affidavit is concerned, that too is personal information and cannot be disclosed u/s 8(1)(j) Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information: Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person. Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information: Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person. 10. However, as the appellant has alleged forgery in the documents submitted by Shri Hari Singh, DG, DGR, MOD, New Delhi to get an enquiry conducted into the veracity of the documents submitted by Shri Hari Singh and the appellant be informed if the information provided by him was found to be true or false, under intimation to the Commission. The above orders be complied with within thirty days from date of receipt of the order. The appeal is disposed of.
