Copy of review petition filed in the Supreme Court of India in Civil Appeal

The appellant filed an application under the Right to Information (RTI) Act with the Life Insurance Corporation of India (LIC) seeking information regarding copy of the review petition filed in the Supreme Court of India in Civil Appeal. The Public Information Officer (PIO) denied disclosure of the information claiming exemption under section 8(1)(d) Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information including commercial confidence, trade secrets or intellectual property, the disclosure of which would harm the competitive position of a third party, unless the competent authority is satisfied that larger public interest warrants the disclosure of such information; of the RTI Act and stating that disclosure would harm the competitive position of LIC in the ongoing litigation.

The Central Information Commission (CIC) observed that following the filing of the review petition by LIC of India before the Supreme Court of India, this information is not held by the public authority and belongs to the honorable Apex Court. The CIC advised the appellant to apply for this information to the apex court as per the rules of the Supreme Court of India.
