The appellant has sought the following information:
1. Provide the reasons for not adjusting the bills of OB List pertaining to the appellant. Provide complete details in respect of the following bills:
(i) OB-534-05-06-17 for Rs.15000/- and
(ii) OB-632-14-06-17 for Rs.30875/-.
2. Provide details of action taken on the communications dated 07/10/2019 and 24/10/2019 of the appellant sent to Admn. Officer, AMPRI, with regard to OB List.
3. Provide a copy of the complaint made by Mr. Saurabh Sethia.
4. And other related information.
Grounds for Second Appeal
The CPIO did not provide the desired information.
Submissions made by Appellant and Respondent during Hearing:
The appellant submitted that he is not satisfied with the reply.
The CPIO submitted that on 27.11.2020 a reply was given. The FAA submitted that on 19.01.2021 the first appeal was also disposed of. However, as the copies were not available, they were told to read the contents during the proceedings.
Observations:
On hearing the reply, it was clear that information sought was not given on points no. 3 onwards, also the reply on points no. 1 and 2 was not as per the RTI application. It is relevant to mention here that reasons as asked in point no. 1 of the RTI application is not covered u/s 2(f) “information” means any material in any form, including records, documents, memos, e-mails, opinions, advices, press releases, circulars, orders, logbooks, contracts, reports, papers, samples, models, data material held in any electronic form and information relating to any private body which can be accessed by a public authority under any other law for the time being in force; of the RTI Act. In respect of point no. 2 action taken or not taken should be categorically informed. The FAA also appeared to have failed to pass a speaking order.
Decision:
In view of the above observations, a final opportunity is given to the CPIO to take corrective steps and provide a final point-wise reply to the appellant on all the points within 7 days from the date of receipt of the order.
