The Appellant sought some details about the candidates who had been called for interview for the post of Assistant Legal Advisor. The PIO denied the information related to the qualification and experience of the candidates called for interview under section 8(1)(e) Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information available to a person in his fiduciary relationship, unless the competent authority is satisfied that the larger public interest warrants the disclosure of such information; of the RTI Act, stating that such information was held in a fiduciary capacity. The Appellate Authority upheld the order of the PIO.

The appellant submitted that she wanted this information in order to satisfy herself if she had been rightly denied the opportunity of appearing before the Interview Board. The Commission held that the criteria based on which any individual candidate is found eligible for employment must be disclosed and directed the PIO to provide to the Appellant the details of the qualifications and the experience of the candidate(s) selected for the post.
