Disclosure of enquiry report of sexual harassment under RTI

An enquiry was conducted against a Post Master General regarding an allegation of sexual harassment of the female staff. He filed an application under Right to Information (RTI) seeking a copy of the entire file related to the issue. The Public Information Officer (PIO) refused for the disclosure and stated that disclosure of information at this stage was not permissible as the file was under submission to the Minister and it was not known as to when it will be received back in the Department. The appellant argued that some time frame should be fixed for the supply of the requisite information lest it would remain pending ad-infinitum.

The Central Information Commission (CIC) observed that the submissions of the appellant are valid and directed the PIO to provide requisite information preferably within two months. The Commission held that if the file does not return from the Minister, the appellant should be informed accordingly.
