Information sought
1. Provide the day wise action taken on the complaint dated 26/11/2014-09/12-2014 filed against Sameer Ispat.
2. Provide the copy of the enquiry held by the department in respect of the above.
3. If no action has been taken provide reason for the same and name of the officer responsible for the same.
4. Provide the assessment of PF and pension amount of each employee whose name has been mentioned in the above said complaint.

The CPIO has not provided the desired information.
Relevant Facts emerging during Hearing: The following were present Appellant: Mr. Kishan Pal & Mr. Satyendra Kumar Advocate (M: 9319918845) through VC Respondent: Mr. M S Arya CPIO through TC M: 07838262897
The applicant stated that he was an employee of Sameer Ispat. He informed that he had lodged a complaint with EPFO regarding non-deposit of his & six other workers PF and the respondent had deputed an enforcement officer to look into the matter and he wants a copy of the report submitted by him. He informed that the enforcement did not contact any of the workers named in the complaint. He added that Labour Commissioner at Saharanpur has held that the workers named in the complaint were employees of Sameer Ispat. The CPIO stated that the enforcement officer who visited the entity was informed by the establishment that none of the seven workers were ever employed with them. He submitted that copy of the enforcement officer’s report will be forwarded to the applicant. He added that if the applicant and other workers provide him a copy of the order passed by the Labour Commissioner he will institute a proper enquiry against the establishment under Section 7A of the EPF Act.
Decision notice:
The CPIO should provide a copy of the report submitted the enforcement officer to the applicant forthwith. Further, as assured the CPIO should institute a proper enquiry as soon as the applicant and other workers provide copy of the order passed by the Labour Commissioner.
The appeal is disposed of accordingly.
