FAA: The information of CPIO, Base hospital is not available on RTI portal - CIC: Complaint identical to those in the appeals disposed of on 08.01.2024; The issues having attained finality, there is no public interest in further prolonging the matter

Information sought:
The Complainant filed an RTI application dated 21.05.2022 seeking the following information:
“Seeking the following information of Lt. Colonel Bijaya Saha, MNS, IC no.******42X, posted at 92 Base Hospital, Badami Bagh Cantonment, Srinagar under provisions of the RTI Act 2005.
1. Date of joining at 92 Base Hospital, Badami Bagh Cantonment, Srinagar on transfer from Base Hospital, Barrackpore cantonment, North 24 parganas, West Bengal.
2. Present address details (Quarter or transit accommodation) of Bijaya Saha at Badami Bagh Cantonment, Srinagar.”
The CPIO furnished a reply to the complainant on 07.06.2022 stating as under:
“The RTI does not pertains to this office.”
Being dissatisfied, the complainant filed a First Appeal dated 08.06.2022. The FAA vide its order dated 12.09.2022, held as under:
“The information of CPIO, Base hospital is not available on RTI portal.”
Feeling aggrieved and dissatisfied, complainant approached the Commission with the instant Complaint.

The complainant inter alia submitted that desired information was not provided by the respondent till the date of hearing. On a query from the Commission, the complainant confirmed that his divorce proceeding started in 2021 and culminated in divorce being granted in July 2023.
Decision:
The Commission after adverting to the facts and circumstances of the case, hearing the complainant and perusal of the records, notes that the issues raised in this complaint are identical to those in the appeals file Nos. CIC/MODEF/A/2022/640320 disposed of by the Commission on 08.01.2024. In view of the above and the issues having attained finality, there is no public interest in further prolonging the matter. That being so and in the absence of any mala fide on part of the respondent, the Commission is not inclined to proceed any penalty proceeding in this matter.
The Complaint is disposed of accordingly.
