Grant of compensation for non-supply of information

The Appellant sought certified copy of the minutes of the Departmental Promotion Committee held for promotion in Pay Scale of Rs. 1600-2600 (subsequently revised to Rs. 5,000-8,000) under Vth Pay Commission Report.

The Commission observed that the core issue was not being addressed in the orders passed by the Public Information Officer (PIO) and First Appellate Authority. Referring to the fax received from the First Appellate Authority requesting for the dismissal of the appeal, the Commission noted that no mention has been made whether copy of the DPC proceedings have been supplied to the appellant or not. Therefore, the Commission directed the PIO to provide the copy of the relevant DPC proceedings. Further, the Commission held that non-supply of the information has caused detriment to the appellant directed to award a compensation of Rs. 2,000/- under section 19(8) (b) of the RTI Act.
Comments
A PIO should be careful while putting up the case before the Commission. Incomplete presentation of facts may lead to grant of compensation or levy of penalty.
