The appellant filed a second appeal on 26.12.2011with the Commission.

2. Due to technical problems, the hearing through video conferencing could not be held. The complainant was contacted on mobile phone. The respondent participated in the hearing personally.
3. The complainant referred to his complaint dated 26.12.2011 filed before the Commission and reiterated the contents. The complainant stated that the respondent organization has not complied with the provisions of the RTI Act in section 4(1)(b) Every public authority shall publish within one hundred and twenty days from the enactment of this Act,- (i) the particulars of its organisation, functions and duties; (ii) the powers and duties of its officers and employees; (iii) the procedure followed in the decision making process, including channels of supervision and accountability; (iv) the norms set by it for the discharge of its functions; 4. The complainant stated that he has in his comprehensive complaint provided the basis of his complaint and elaborated his points by the screenshots of the website. The complainant stated, for instance, that the screenshots of the website of the respondent organization bring out a list of 18 uploads under the subject "Right to Information and Orders", but the contents are misleading because 16 of the 18 uploads relate only to establishment matters, and that the other two are only elaborations of the organizational structure.
5. The complainant stated that compliance of the section is mandatory but it is quite apparent that the respondent organization has been casual about their approach. The complainant stated that in this light, the respondent organization should be held responsible for the negligence in the compliance and they should be directed under section 2(b) of the RTI Act to do the needful in an effective manner so that compliance with section 4(1)(b) Every public authority shall publish within one hundred and twenty days from the enactment of this Act,- (i) the particulars of its organisation, functions and duties; 6. The respondent stated that this complaint was not in the knowledge of the respondent organization. The respondent stated that it was only on 16th June 2014 consequent to the notice of the hearing, that they learnt about the complaint and they immediately contacted the CIC Office to procure the mobile phone number of the complainant to contact him. The respondent stated that they could not contact the complainant. The respondent stated that, in any case, in the last 2 or 3 days they have made serious efforts to upgrade the information site and that they feel that they have been able to do a lot. The respondent stated that the information is presently available in a scattered form and they would need 3 months to put it in proper shape.
7.The respondent stated that a comprehensive response has been sent to the complainant on 19.06.2014 in which they have given a complete idea of the current position in respect of the upgrading of the RTI site with reference to section 4(1)(b) Every public authority shall publish within one hundred and twenty days from the enactment of this Act,- (i) the particulars of its organisation, functions and duties; The respondent reiterated that they be allowed a period of 3 months in which they would be able to consolidate the information.
8. The complainant stated that he doubts whether the respondent has fully comprehended the purport of the section in respect of the self disclosure clauses and whether they have a complete understanding of what is expected under the provision.
9. The complainant stated that it would be best for the respondent organization to visit some of the websites of the institutions, who have done serious work under the suo motu disclosure system. The complainant said that the CIC website itself would be a good example for the respondent organization to follow and there are other sites also.

The complainant stated that the respondent organization should be given the time they seek but at the expiry of that period, the respondent organization should be expected to give a compliance report to the Commission on the steps that have been taken by the respondent, taking into account the various clauses of section 4(1)(b) Every public authority shall publish within one hundred and twenty days from the enactment of this Act,- (i) the particulars of its organisation, functions and duties; The complainant further said that it would be appropriate if the respondent should send the complainant a copy of the compliance report.
Decision:
11. The respondent is directed to take effective steps to fulfil the assurances they have given in the course of the hearing with a view to ensuring compliance with section 4(1)(b) Every public authority shall publish within one hundred and twenty days from the enactment of this Act,- (i) the particulars of its organisation, functions and duties; (ii) the powers and duties of its officers and employees; (iii) the procedure followed in the decision making process, including channels of supervision and accountability; (iv) the norms set by it for the discharge of its functions; (v) the rules, regulations, instructions, manuals and records, held by it or under its control or used by its employees for discharging its functions; (vi) a statement of the categories of documents that are held by it or under its control;
