The appellant has sought the following information:-
- Provide copies of the documents related to the transfer/ selling of land of Khasra No. 318, Raipur, Dehradun to the Army as also the date of the transfer of the said land to the Army.
- Provide the total area of the land which was transferred to the Army out of the said Khasra No.318.
Grounds for filing Second Appeal:
The CPIO did not provide the desired information.
Submissions made by Appellant and Respondent during Hearing:
The appellant submitted that he need the documents in hard copies and is unable to go to the office of the respondent for inspection. The CPIO submitted that the appellant can approach Defence Estate Office, Dehradun for inspection as the documents are now available in that office.
Observations:
Based on a perusal of the record, it was noted that the CPIO Meerut Division vide letter dated 30.07.2020 replied to the appellant and stated that the khasra number is mentioned but the name of the Army unit under whom the jurisdiction falls is not there, therefore, he requested the appellant to provide the details of the Army unit. Thereafter, another reply on record is from CPIO, Defence Estates Office, Meerut in which it was stated that information sought appears to be research based and therefore, it is difficult to cull out the information. He was requested to avail inspection and obtain relevant copies on payment of fees.
The appellant in his second appeal mentioned that he is 78 years old and is a heart patient, therefore, cannot go for inspection. The CPIO was therefore asked under whose jurisdiction the particular land Khasra No. 318, Raipur, Dehradun is, as it is an immovable property and not very difficult to locate, he submitted that Defence Estate Office, Dehradun is the custodian.
Be that as it may, as the Defence Estate Office, Dehradun was not called for hearing, the CPIO, Defence Estate Office, Meerut shall serve a copy of this order to the CPIO, Dehradun and inform him to comply with this order.
Decision:
The CPIO, Defence Estate Office, Meerut shall serve a copy of this order to Defence Estate Office, Dehradun and ensure that inspection is provided to the appellant at a mutually convenient date and time, the contact number and name, designation of the CPIO Dehradun shall be given to the appellant by the CPIO Meerut within 3 days from the date of receipt of this order.
The CPIO, Dehradun shall submit a compliance report within 15 days from the date of receipt of this order and a copy of the acknowledgment from the appellant that inspection was given to him.
The appeal is disposed of accordingly
