Notice to PIO for failing to provide information under RTI
29 Dec, 2012An application was filed with the office of Inspector General of CID wing of police seeking information about under-trials, detainees and persons booked under the Public Safety Act (PSA) in Jammu & Kashmir.
The Deputy Inspector General of Police Prisons and CID wing of JK police had denied providing the information, after which the applicant approached the State Information Commission (SIC). The SIC has directed the serving Public Information Officer (PIO) to pass the fresh order over the RTI application and has quashed the earlier order passed on behalf of the IGP CID as under Section (5) of the State RTI Act, 2009 only a person, designated as PIO by the Public Authority has the authority to pass an order over an RTI query.
The SIC has also served notice to the former PIO of the office of Inspector General of CID wing of police to show cause as to why penalty under section 17 of the State RTI Act shouldn’t imposed upon him for failing to pass order over the RTI application.
