Is a PIO expected to take an action if requested under RTI application?
20 Dec, 2012The appellant filed an application under the Right to Information (RTI) Act with the Northern Railway in which he wanted the PIO to take action against a TTE who had not given him a seat in the shatabdi express even though he had produced the duty pass. The Public Information Officer (PIO) informed the appellant that the upgraded chart reservation is provided only a few minutes before the train’s departure and before that it is not possible for the TTE to give any seat to any passenger. The PIO also noted that the applicant had not contacted the TTE at the correct time.

The Central Information Commission (CIC) observed that the applicant is not seeking any information in his RTI application and is simply insisting that the PIO take action against the TTE for not providing him a seat although he was carrying his duty pass. The Commission rejected the appeal holding that the relief sought by the applicant falls outside the ambit of the RTI Act.
