Should the information held as per the stay order of the court be disclosed?

The Appellant sought detailed information regarding the number of applications for home loan and education loan received, selected and total amount given for them since 2006 up to 2010 through all over India. Further he asked the details of Assets and Income Tax returned filed by Officers of Scale IV up to VII since 2005 up to 2010 along with the various facilities like Petrol, House allowances, medical provided to the Staff for the same. He also asked for the copies of agreement with the Foreign Countries from 2006 to 2010 and the details of employees made foreign tours and their entertainment like tea, coffee since 2005 up to 2010. No reply was received in the mandated time period from the PIO. On appeal, the First Appellate Authority (FAA) noted that the PIO had referred the matter to the concerned Department of the Bank and a reply was awaited. FAA noted that there has been a delay in disposal of RTI request, as the information was not readily available with the PIO and directed to dispose the RTI application within 15 working days.

During the hearing the respondent stated that all the information on all the queries has been already provided except the query related with the Asset and Income Tax returns of the officers as the Bank had obtain a stay from the High Court. Therefore, the Commission rejected the appeal.
