The CPIO has not provided the desired information.
Submissions made by Appellant and Respondent during Hearing:
The appellant contested the reply of the CPIO in respect of points no. 3(b) and (c) of the RTI application. He alleged that the reply given is false. The CPIO submitted that a suitable reply was given vide letter dated 18.12.2018.
Observations:
Based on a perusal of the record, it was noted that the CPIO vide letter dated 18.12.2018 had provided a point-wise reply to the appellant. On a query, the CPIO submitted that the reply provided in respect of points no. 3(b) and (c) were correct and as per the record.
Decision:
The CPIO is directed to affirm on affidavit and submit to the Commission with a copy duly endorsed to the appellant, that the reply given in respect of points no. 3(b) and (c) were factual and as per the record.
The appeal is disposed of accordingly.
