17 May, 2021CIC: The RTI Application, First Appeal & Second Appeal have been signed in the name of “A S Bhullar & Associates‘’ - CIC: Section 3 of the RTI Act stipulates that “Subject to the provisions of this Act, all citizens shall have the right to information” - CIC: The instant case has been made to appear as being filed in the capacity of a firm and not as an individual citizen despite the fact that the letter head used by A S Bhullar mentions his name. It would have been appropriate for A S Bhullar to have signed the RTI Application & Appeals in his own name. He is advised accordingly for the future. Further, information is exempt under Section 8(1)(j) Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information: Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person. Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information: Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person. Information sought and background of the case:
The Appellant filed an RTI application on 28.02.2019 seeking information in respect of Mr. Jagbir Alhawat, Professor, Maharaja Surajmal Institute, C-4 Janak purl, New Delhi, including inter-alia:
“1. Give the copy of application submitted by Mr. Jagbir Alhawat, Professor, Maharaja Surajmal Institute, C-4 Janak purl, New Delhi for the post of associate professor and professor in 2014, 2015 and 2016, 2017.
2. Also give copy of all document i.e all education certificates, all research papers copies and copy of books along with book name ISBN No. and publisher name.
3. Give report of his applications if he was found eligible or not eligible.”
The CPIO replied to the appellant on 01.04.2019 stating that:-
“Point Nos. 1 to 3:- questions is not specific”
Being dissatisfied, the appellant filed a First Appeal dated 23.04.2019. FAA’s order dated 27.05.2019 upheld the CPIO reply.
Feeling aggrieved and dissatisfied, appellant approached the Commission with the instant Second Appeal.
Relevant Facts emerging during Hearing:
The following were present:-
Appellant: Present through audio conference.
Respondent: Kulwant Singh, Assistant Professor & CPIO present through audio conference.
The CPIO submitted that the Appellant has not specified in his RTI Application for which year he has sought for the application submitted by the averred individual. He further submitted that as such this information cannot be provided as it pertains to the personal information of a third party and is exempt from disclosure under Section 8(1)(j) Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information: Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person. Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information: Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person. The Appellant objected to the denial of the information and stated that since the application form and related documents were submitted by the individual for appointment to a public post, the same should be made available to him.
Decision
The Commission observes at the outset that the instant RTI Application, First Appeal & Second Appeal have been signed in the name of “A S Bhullar & Associates‘’. It may be noted that Section 3 of the RTI Act stipulates that
“Subject to the provisions of this Act, all citizens shall have the right to information.”
Having observed as above, the instant case has been made to appear as being filed in the capacity of a firm and not as an individual citizen despite the fact that the letter head used by A S Bhullar mentions his name. It would have been appropriate for A S Bhullar to have signed the RTI Application & Appeals in his own name. He is advised accordingly for the future.
Notwithstanding the aforesaid, even if liberal consideration is accorded to the case, the fact remains that the information sought for in the RTI Application stands exempted under Section 8(1)(j) Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information: Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person. Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information: Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person. Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information: Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person. Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information: Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person. of the RTI Act. This observation is in line with a judgment of the Hon’ble Supreme Court in the matter of Central Public Information Officer, Supreme Court of India Vs. Subhash Chandra Agarwal in Civil Appeal No. 10044 of 2010 with Civil Appeal No. 10045 of 2010 and Civil Appeal No. 2683 of 2010 wherein the import of “personal information” envisaged under Section 8(1)(j) Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information: Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person. Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information: Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person. Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information: Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person. of RTI Act has been exemplified in the context of earlier ratios laid down by the same Court in the matter(s) of Canara Bank Vs. C.S. Shyam in Civil Appeal No.22 of 2009; Girish Ramchandra Deshpande vs. Central Information Commissioner & Ors., (2013) 1 SCC 212 and R.K. Jain vs. Union of India & Anr., (2013) 14 SCC 794.
The appeal is disposed of accordingly.
