Different yardsticks should not apply to providing documents to an employee
Ref: Information was denied u/s 8(1)(g) Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information, the disclosure of which would endanger the life or physical safety of any person or identify the source of information or assistance given in confidence for law enforcement or security purposes; & 8(1)(h) Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen, information which would impede the process of investigation or apprehension or prosecution of offenders; on the basis of investigation initiated by a memorandum issued by the respondent - the said memorandum was quashed by CAT - CIC: provide the information if no stay is granted by Higher Court
Respected Sir, I studied the entire case. My opinion is that the individual got stay orders or not, all the relevant documents requested by the individual must be supplied beyond the reasonable doubt. If stay is sanctioned, one kind of instructions on RTI, if stay is not sanctioned one of rules - This is not justifiable. Where shall an employee go? The employee must be provided all the relevant information. If the entire information is given to him, what and where is the loss to the institution?
